Forrest Gilliam sent the following letter to the members of the Smoking Taskforce on November 28th.

November 27, 2007

Dear Smoking Task Force Member:

Thank you for your hard work on the Smoking Task Force this semester. You have been given a difficult issue to resolve in half the time it requires, and the campus is anticipating your recommendation soon. As you enter your final weeks of consideration I urge you to reach a decision that both protects the rights of smokers and non-smokers. I believe neither a 100 foot limit nor a smoke free campus will achieve this goal.
College is an important transition for many students, particularly those of the traditional college going age. Part of this transition is learning to make your own decisions regarding your lifestyle. Examples include choosing what to eat, what to drink, to smoke or not to smoke, who to date, whether or not to go to class, whether or not to study, and whether or not to get a job. For the most part college campuses leave these decisions up to the individual student unless state or federal law forces their intervention. The state legislation passed this summer and the subsequent creation of this task force has presented a temptation for some to meddle in what should be an individual decision.
The administration, faculty, and staff at a university are not parents of the students who attend, and cannot keep those students from making poor choices. Students are aware of the negative affects of smoking, and most choose not to smoke as a result, but some still choose to smoke. While their decision may not be wise, it is theirs to make, just as it is my decision to eat deep fried foods and not exercise. Adults in North Carolina can legally smoke, and the concept of a college campus being a place where certain legal rights are taken away is concerning. There are already examples, but they are few, and I think we need to keep it that way.
I also ask that you be realistic when making your recommendation and realize that enforcement of any policy will be a challenge. There is no way for our campus police to catch even a small portion of the alcohol violations on campus, and the smoking policy will be even more difficult to enforce. An unenforceable policy will teach the young people you so admirably want to protect that rules are meant simply as a formal way to pass judgment on those who break them, and not as a form of protection. You can more easily accomplish the goal by adopting a statement that says: “Appalachian State University frowns on those who smoke”.
I have spoken with many students about this issue, and I have heard many different opinions. I know that some students would be happy to see a smoke free campus, but I also know many students who believe the personal rights of individuals should not be taken away if they are not infringing on the rights of others. You can prevent smokers from infringing on the rights of non-smokers by prohibiting smoking within 25 to 35 feet of buildings or by creating designated smoking zones. Such restrictions, accompanied by a campus-wide campaign encouraging respect for others, can help solve the problem of second-hand smoke. To address the needs of students who wish to stop smoking, we can do a better job of advertising the smoking cessation programs that are currently available, possibly expanding some programs.
As you make your final recommendation next week, I hope you consider a variety of factors, including the feedback you received from several groups on campus, the logistics of enforcing the policy, and the willingness to respect the personal decisions of our students, staff, and faculty. An institute of higher learning is often tempted to make social statements, and I believe you can make no stronger statement than to respect the personal decisions made by your constituents that are within their legal rights.

Sincerely,

Forrest S. Gilliam
Student Body President
